NT Police Commissioner Martin Dole has lost a legal bid to keep “serious allegations” about misconduct of officers made by a former assistant commissioner secret, after ineffectively arguing their conduct was “sensitive” and that he preferred the allegations “remain confidential” before a potential settlement could be arranged.
The allegations were made by former assistant commissioner Sachin Sharma as part of legal action he is taking in Federal Court against the NT Police and NT Government, alleging they contravened the Fair Work Act. He is seeking declarations, compensation and pecuniary penalties.
I note with interest Justice McDonald also states at paragraph 46 in his Federal Court of Australia decision that the NT Police Force Commissioner is even pleading to the Federal Court as to whether or not the Fair Work Act (Cth) has application to Officers of the Northern Territory Police Force.
Will the NT Police Force Commissioner now make available his pleadings as to why he and his legal team are pleading that the Fair Work Act (Cth) may not have application to Officers of the Northern Territory Police Force.
