The Department of Logistics and Infrastructure has been fined and convicted for breaching the conditions of an Aboriginal Areas Protection Authority certificate, which led to damage at a sacred site in a remote Central Australian community, and follows a costly, years-long court battle in which it attempted to defend its actions.
AAPA started the legal action back in 2022, alleging the department damaged a sacred white gum tree in 2021 while carrying out roadworks at Arlparra, that it was aware of the sacred site boundary and the tree’s significance but failed to carry out proper surveys, failed to include the boundary in contract documents and approved construction in breach of the authority certificate.
