The driver of a ute towing a caravan who was involved in the fatal incident that killed eight-year-old boy Brettson Payne in Katherine on Sunday has been charged.

NT Police say 31-year-old driver from Katherine was travelling with nine children when the accident happened, with four inside the caravan. Authorities said a number of the children were unrestrained.

Police did not provide details of how the kids came to be in the utility vehicle.

The boy reportedly died after falling onto the roadway from a white Roma caravan when its door opened while it was being towed by the white Mazda ute along Edith Farms Road in Katherine. It’s believed he was unrestrained.

The child suffered critical injuries and was later pronounced dead upon arrival at the Katherine District Hospital.

It’s understood NT Police charged the 31-year-old driver with driving a motor vehicle causing death and that the man is not in custody, however police did not include those details in the statement.

The driver will appear in Katherine Local Court nearly two months from now on August 10.

NT Police said Major Crash and local detectives are continuing with the investigation.
