‘Disclosure would be wise’: ICAC issues warning to NT politicians to disclose all conflicts after Fyles resignation

Independent Commissioner Against Corruption Michael Riches has issued an extraordinary warning to Territory politicians to disclose all their conflicts to him directly, while indicating “recent matters” involving “conflicts of interest, lobbying and related matters” presumably involving Natasha Fyles would be “addressed”.

The statement, released two hours after Natasha Fyles resigned as chief minister for failing to disclose shares in a mining company she made decisions about, called on all members of the Legislative Assembly to report to him all financial and personal interests that may conflict with their duties.

“While there is no obligation to do so, I invite all members of the Legislative Assembly to proactively disclose to me any financial or personal interests that may conflict, may be perceived to conflict, or may potentially conflict, with their official duties,” Mr Riches said.

“I think such proactive disclosure would be wise, notwithstanding that those disclosures may have been made in other forums.”

Mr Riches added that his suggestion to disclose to him did not only apply to politicians, but also to all public officers.

“I also urge all public officers, regardless of their position or seniority, to take the time to review and update any disclosures that have been made, or are required to be made,” he said in the statement.

“Careful consideration should be given to whether any of those interests are in conflict, or could be perceived to be in conflict, with their duties. Where such a conflict exists, immediate action is to be taken to disclose those conflicts so that they can be properly managed.

“Public officers ought not disregard this advice.”

Back at Estimates hearings in June, Ms Fyles revealed that Mr Riches had provided her Cabinet team with a briefing about how to handle conflicts of interest.

“It is important to be aware of how you would manage it and what is a conflict,” Ms Fyles said in Parliament at the time about the briefing session.

“You can always keep educating yourself.”

Ms Fyles was referred to the ICAC by independent MLA Mark Turner last week for various conflicts of interest, as well as the murky contract under which Ms Fyles hired her senior adviser Gerard Richardson with taxpayer money.

The NT Independent revealed that Mr Richardson’s consultancy company Brookline Advisory was listed on the federal lobbyist register as a lobbyist for Tamboran Resources, a gas company the Fyles Government pre-approved to frack in the Beetaloo Basin and offered land at Middle Arm for a massive LNG plant.

Ms Fyles was forced last month to divest other shares she had in Woodside Energy, a gas giant with interests in the proposed Middle Arm project that became the focus of Ms Fyles’ leadership.

Mr Riches would not comment further on those matters, only to say “they will be addressed”.
