  3. In the Northern Territory, we have Australian Federal Police Officers who are based and work in the Northern Territory who are covered by the Fair Work Act (Cth) and their enterprise agreements are approved by and dealt with and are lodged in the Fair Work Commission.

    In the Northern Territory, we have Northern Territory Police Officers who are based and work in the Northern Territory who are not covered by the Fair Work Act (Cth) and their Northern Territory Police Force (NTPF) Consent Agreement 2022 is not lodged in the Fair Work Commission but is lodged in the Northern Territory Police Arbitral Tribunal.

    Is it not time to ensure that all Police officers in the Northern Territory, be they Australian Federal Police Officers and or Northern Territory Police Officers, are covered by the Fair Work Act (Cth) and that their enterprise agreements are approved by and dealt with and are lodged in the Fair Work Commission?

    Is it not time that our Northern Territory Parliament abolishes the Northern Territory Police Arbitral Tribunal so that Northern Territory Police Officers employment matters can be dealt with by the Fair Work Commission?

  5. That “education tool” comment was both supremely patronising and condescending. How dare you treat us all like that.

    Interstate lawyer: shows what he thinks about local lawyers or he thinks there may not be any in the NT who can be objective enough. Wonder where he would get an idea like that from?

    If that negligence finding stands up, which it should, then anyone who didn’t get that job his mate got instead should seriously look into starting legal proceedings against Murphy and whoever else was involved, for damages (financial and psychological-that’s got ‘Adjustment Disorder with depression and anxiety’ written all over it) stemming directly from his negligence, which by default has ‘intent’ behind it.

    Think of all juicy emails and texts you’d be able to request and subpoena and put into a public court case!

    And you could easily represent yourself too, we know others who have done so without any legal training and it will cost them a heap to try and defend. Tie him up in legal spider web, keep him and his ‘negligent’ behaviour in the public arena for years.

    We think we know what those recommendations are by the way:

    Don’t be f**king corrupt.

    A finding such as that surely must be classed as serious misconduct which would allow for instant dismissal. Do not pass Go, do not collect $200.

    The natural justice process had already been given through the ICAC investigation. We think she could have terminated his employment due to their finding causing serious damage to the reputation of the employer not to mention public trust, for starters.

    From FairWork:
    ‘If, after considering all the evidence (including statements given by witnesses), and after considering the employee’s explanation, you come to the conclusion that the employee has in fact engaged in misconduct [ICAC did all that work for you Lia], you may then be able to terminate the employee without giving them any notice. This must be done in writing, and you should always give reasons as to why you are terminating the employee.’

    Lastly, see how easy it is to release the ICAC report when you want to! Well it’s the same for changing legislation. And enforcing (or choosing not to) codes of conduct etc etc.

    The ‘Political Will’ to do the right thing is all it takes (and doesn’t take if you think about the opposite).

    You can if and when you want to, you just choose not to: all you Lawlers, Fyles-es, Rowes, Gunners, Finocchiaros, Shamahans, Kirkmans, the list goes on…
