The CLP Government will introduce amendments to domestic and family violence laws that will see mandatory sentencing reinstated on a “tiered framework” with some offenders jailed for breaches of “certain” domestic violence orders, however the government stopped short of reinstating mandatory minimum sentences for all DVO breaches.
The tiered sentencing framework will see jail time from two to five years for breaches including by those who have threatened harm to a victim, if they had a prior breach of a DVO or for repeat breaches of a DVO “within a short time”.

DV is terrible, don’t get me wrong, but isn’t mandatory sentencing unconstitutional? Didn’t the High Court find that only the courts can impose punishment, not politicians? You legal experts, help me out here.
